Initiation and Completion of Project
1) SPELLBRAND LTD will begin creation of a logo design (THE PROJECT) upon receipt of a fee from THE
CLIENT.
2) Upon completion of THE PROJECT, SPELLBRAND LTD will to transfer electronic files relating to
the FINAL DESIGN of THE PROJECT to THE CLIENT via
download from SPELLBRAND LTD website or email.
SPELLBRAND LTD retains the copyrights to all designs resulting from THE PROJECT except
the FINAL DESIGN approved by the client. Once the electronic source files
(EPS, AI, CDR, HTML and/or FLA files) of any of our design services, are
delivered to the client (either via email or via download from our servers),
the project is deemed completed and closed. Any further changes, edits and
other requests will be charged at our hourly rate.

Once THE PROJECT has been initiated the rules outlined in the
refund policy section
of the website are in effect. The client will NOT be eligible for any refund
if the
projects details form is NOT submitted with in 2 business days of
the payment and/or if the client wishes to cancel the project before the
concepts are delivered.
During Project Life Cycle
4)
If the client does not communicate with the SPELLBRAND LTD for more than 12
days at any stage of the design process, the project will be de-activated and
a fee £100 will be charged to re-activate the project. This condition is
communicated to the client several times during the project sign up and while
accessing the design on the studio floor.
5) If the client had
selected and paid for several services at a time then it is not possible to
cancel the projects that did not commence. All fees related to such projects
are non-refundable as per our refund policy.
6) After a project is initiated and the client wants
to change the project scope before or after the initial design concepts have
been presented to the client, that will considered as a separate project which
would require the full project fees to be paid. The fees for the original
project are then non-refundable. This also applies to the project when it is
in the revision round phase. Additional requests such as additional elements
of the logo design, additional content and/or images in brochures, flyers,
websites, greeting card and other marketing material design, that we are
working on, will be charged extra to incorporate into the project. The project can be terminated if SPELLBRAND LTD
considers that the client is abusing the "unlimited revisions" feature of the
logo design packages. What constitutes "abuse" is solely up to SPELLBRAND LTD.
Copyright Issues
7)
All designs that result from a project life cycle remain the copyright of
SPELLBRAND LTD except for the final design which has been approved by the
client.
8) SPELLBRAND LTD reserves
the right to display any design that it has created for the client in its
portfolio or other marketing material. SPELLBRAND LTD also reserves the right
to display any messages or comments or testimonials given by the client.
9) SPELLBRAND LTD is not liable for any loss or damage that might result from
the use of the designs created by SPELLBRAND LTD.

Due to the complexities of international copyright and trademark law,
SPELLBRAND LTD will not be held liable should THE CLIENT be found to be
infringing on an already existing
copyrights or trademarks
or service mark relating to the project name, description or service.
When a design has been finalised THE CLIENT should
conduct a copyright and/or trademark search before closing the project.
Alternatively the client can engage SPELLBRAND LTD to do this search on
their behalf.
About Bonuses
11) SPELLBRAND LTD retains the right to
cancel any bonuses published on the website at any stage of the THE PROJECT.
12) The free professional website template
that is provided with the Professional and Professional PLUS packages can be used
only if the link to SPELLBRAND LTD appears on all original and any new pages
created from the template.
13) The combo packages such
as Basic PLUS and Pro PLUS do NOT include free business card printing or any
other bonuses.
Payment and Turnaround times
14) THE PROJECT is charged at the rate that is in
effect at the time the project is accepted by SPELLBRAND LTD and is not affected by any
subsequent changes to the rates. In some cases projects may require a signed payment authorization form, or
telephone payment verification before scheduling.
15) For payment options
please read our payment details page. SPELLBRAND LTD reserves the right to
cancel any order and refund the amount paid before starting the project.
Further more SPELLBRAND LTD is not liable for loss of the fee paid due to
transactions being lost with the payment processors (PAYPAL and 2Checkout) or
any other related problems.
